Partial Appellate Victory

Mr. Leonardo's appeal of a family law decision was upheld in part.  The trial court had failed to rule on a motion made by the client, but the trial judge insisted he had already made a ruling on that motion.  The appellate court found that not to be the case and has returned the matter to the trial court to rule on the client's motion.  The bigger issue was the client's health insurance.  The original court order many years ago required the husband to pay for the wife's health insurance until age 65. The trial court then terminated that provision as of the date of their divorce in 2010.  The appellate court agreed that the termination of that provision was arbitrary and reinstated the provision which now requires the husband to pay for the client's health insurance until age 65.
